TEI Urges California Supreme Court to Grant Review in River Garden Retirement Home
On September 21, 2010, TEI filed an amicus letter with the California Supreme Court in River Garden Retirement Home v. Franchise Tax Board urging the court to accept the case and clarify the rules for determining remedies when a state tax provision has been found unconstitutional. The amicus letter was filed under the aegis of TEI's State and Local Tax Committee, whose chair is Cathleen Stevens of Brunswick Corporation; Daniel B. De Jong, TEI Tax Counsel, was the principal author of the brief.
TEI Comments on Washington's Emergency Regulations
On September 2, 2010, TEI filed comments suggesting changes to proposed Washington Department of Revenue emergency regulations (WAC 458-20-19401, 458-20-19402 and 458-20-19403) interpreting recently enacted nexus and sales factor sourcing legislation. The comments were filed under the aegis of TEI's State and Local Tax Committee, whose chair is Linda Dickens; Daniel B. De Jong, TEI Tax Counsel, serves as legal staff liaison to the committee.

TEI Responds to Questions from Congressional Subcommittee on State Taxation
On June 25, 2010, TEI filed answers to eight follow up questions issued by the House Judiciary Committee's Subcommittee on Commercial and Administrative Law on The Role of Congress in Developing Apportionment Standards. The Subcommittee issued the questions following TEI Tax Counsel Daniel B. De Jong's May 6, 2010 testimony on that subject.
TEI Supports the Harmonization of Canada's Provincial Sales Tax
On March 25, 2010, TEI filed a letter urging the Canada Department of Finance to permit sufficient time for companies to implement the new harmonized sales tax regime. TEI's letter follows amendments proposed by the Department of Finance on February 25, 2010. The amendment relates to the harmonized sales tax (HST), including place of supply, self-assessment and rebate, and the imported taxable supply rules relating to the provincial component of the HST in regulations under the Excise Tax Act.

TEI Comments on Proposed Wisconsin Combined Reporting Regulations
On October 15, 2009, TEI filed comments on Wisconsin's proposed combined reporting regulations. TEI's comments focused on: (1) the basis of assets owned by corporations that have not previously filed Wisconsin corporate income tax returns; (2) the calculation and sharing of research credits and carryforwards between members of a combined group; (3) the sharing of net business loss carryforwards between members of a combined group; (4) the mechanics of the controlled group election; and (5) the selection of a designated agent for a combined group.
TEI Comments on Proposed Colorado Doing Business Regulation
On October 6, 2009, TEI filed comments opposing Colorado's economic nexus regulation. TEI maintains that if the Proposed Regulation is not revised to require some physical presence in the State, it will violate controlling Commerce Clause jurisprudence and subject both taxpayers and the State to months, and even years, of uncertainty and expense.
